Information is  essential in order for my office to provide legal services.  I will take every reasonable step to ensure the information provided is kept secure, confidential and accurate.  I have developed a  Privacy Policy for the collection, use and disclosure of  personal information consistent with my professional obligations to carry out the instructions of my clients. 

The Privacy Policy has been developed to comply with legislation covering the collection, use and disclosure of personal information. 

Information Covered

The policy covers any personal  information when you visit my Web site, when you request professional services from me or information gathered in the course of providing professional services. The policy also covers any subsequent use or disclosure of such information.

Personal information is any information that is unique or specific to you.  Such information could be your age, name, ethnic origin, religion, opinions or preferences. It does not include information gathered from sources or ways permitted by legislation to be gathered without your consent.

You can  control  what  personal information you provide.  When you visit this website, you can view or print the articles posted without providing any personal information. If you submit a question through the website, or  request professional services either through the website or otherwise,  then you will be required to provide certain basic information required by me to respond or provide services and to meet my professional  and ethical obligations.

Any personal  information you provide will not be disclosed without your consent subject to the following.  Personal information  will be disclosed as necessary for me to provide  professional services, meet my professional and ethical obligations, and where  required by law.  If I am requested by law to disclose information, every reasonable effort will be made to contact you and inform of the legal proceedings so that you can participate and take such steps as you consider appropriate to prevent disclosure.

You can visit my Web site without providing your name or revealing any information about yourself, including your email address.  However, our Web server or the website  may collect certain information such as IP addresses, domain used to access  this website, your  web browser and operating system, the number, duration and frequency of visits to this website. 

To the best of our knowledge as of January 2004, such anonymous information can not be used to identify the visitors to the website.  Such information is used to monitor the usage and performance of the website  for systems administration purposes and to make improvements or enhancements to the website.

I have put in place organizational, physical and technological measures to protect against the loss, misuse or alteration of personal information under our control. Security measures are reviewed as needed to maintain the security and confidentiality of personal information under my control..

CONFLICT OF INTEREST

If we can act for you, we will contact you.

If you provide the information without first being satisfied that we are not in a conflict of interest, then we accept no responsibility for any loss or damage that you suffer or be put to as result of us obtaining such information.  Notwithstanding that you may have provided information to us in such circumstances, we may continue to represent our client.

PRIVILEGE

Information that is provided by a client to a solicitor to obtain legal advice is protected by solicitor-client privilege. The information can not be released or divulged by the solicitor without the consent of the client unless the privilege has first been waived by the client, or the solicitor is bound by a court order to release the information.
